Acceptable
Use Policy
Krypt Technologies, (hereinafter
"Krypt") has drawn up this Acceptable
Use Policy (the "Policy") in order
to protect Krypt and our customers from
any illegal operations which may occur.
Krypt's customers shall not, nor shall they
permit or assist others to abuse or fraudulently
use of Krypt's Services, including but not
limited to the following:
- Sending unsolicited e-mail that causes
complaints from the recipients of such
unsolicited e-mail.
- Mailbombing (sending large quantities
of unwanted or unsolicited e-mail to
individual e-mail accounts; a.k.a. "Spamming").
- Unauthorized attempts by a user to
gain access to any account or computer
resource not belonging to that user
(e.g., "spoofing"). Obtaining
or attempting to obtain service by any
means or device with intent to avoid
payment.
- Absolutely no IRC daemons, eggdrop,
XDCC transfer bots allowed.
- Unauthorized access, alteration,
destruction, or any attempt thereof,
of any information of any Krypt customers,
Krypt, and its end-users by any means
or device.
- Knowingly engage in any activities
that will cause a denial-of-service
(e.g., synchronized number sequence
attacks) to Krypt, any Krypt customers
or end-users.
- Using Krypt's Services to interfere
with the use of the Krypt's network
by other customers or authorized users,
or in violation of the law or in aid
of any unlawful act.
- Using Krypt's Services inappropriately
in ways that can harm Krypt's reputation.
These services are not limited to any
particular service and cover all of
Krypt's Services.
- Excessive use of Krypt's bandwidth
for "streaming" or "mirroring"
files, multimedia, and other large files
is prohibited. All customer's must stay
within their designated bandwidth limits
each month or a burst charge will be
applied per month.
- Storing copyrighted material owned
by others is prohibited. Krypt relieves
itself from all liability steming from
these materials and full responsibility
will be placed soley on the customer.
- Using Krypt's network to send viruses,
worms, trojans or other harmful programs
is prohibited.
- Users caught with any exploitation
programs, virus, worms etc will be punished
according to the laws governing the
state of California and the United States
of America.
- Changing the "kryptsupport"
account on Windows based is strictly
prohibited without the written consent
of a Krypt Technologies' System Administrator.
Removing Remote Administrator or changing
passwords where by Krypt Administrators
can not gain access to the machine is
strictly prohibited.
Each Krypt customer is
responsible for their own actions and, by
accepting service from Krypt, is agreeing
to abide by this Policy. In cases where
Krypt does find misuse of Krypt's Services
or abuse of this policy we will terminate
the account of the offending customer and
take action as Krypt deems appropriate without
notice.
Service Terms
Krypt is connected to a vast network
on the core of the Internet backbone provided
by a large Internet Service Provider (ISP)
supplying the bandwidth and connectivity.
Krypt does not hold itself liable for ISP
down time due to ISP network or server failures.
Krypt does not guarantee "pings"
to Krypt servers as they vary from client
to client depending on geographical location
and their current Internet Service Provider.
Krypt observes the right
to inspect any and all content on Krypt
servers or customer colocated servers as
long as they are connected to Krypt's infrastructure
and network. Any customer found in violation
of the above fore mentioned polocies will
result in termination of service and any
other punishments Krypt deems necessary
as governed by the laws of the state of
California and federal laws.
Credit Card Usage
All credit card transactions will
be subject to offline verification which
includes proper submission of Krypt's Credit
Card Authorization Form or CAF. A copy of
the customer's State/Government issued Identification
Card (ID Card) must also be submitted along
with a front and back copy of the credit
card used in the transaction.
Private Servers
Users agree to keep their servers
password protected 24 hours a day, 7 days
a week if they sign up for any Private server
package. Violation of this policy once will
result in a warning. After that, the server
will be shut down and no refund given or
the clan can upgrade to a public server
package. Clans may give out their server
password for scrims or matches as long as
they change the password once finished with
the scrim. Clans may not post their server
password on any public forum, website, IRC
chat or any other Internet communication
tool for other players to come play on the
server freely. If a Krypt admin finds any
user violating the aforementioned policy
in any way, whether stated above or by the
administrator's own judgement, the rentee
will be contacted and warned.
Contracts and Refund
Policy
A contract must comply with the
Acceptable Use Policy and can not be broken
under any circumstances. If the contract
is not ful-filled in the time space allocated,
the party is held accountable for the balances
due. A contract can not be cancelled under
any circumstance and if payments are not
met, the party shall be held liable. Krypt
holds the right to cancel any written or
verbal contract anytime and withhold all
payments made prior to agreeing to the aforementioned
contract.
If a party wishes to cancel
the aforementioned contract they must notify
Krypt prior to the contract expiration date.
If not, Krypt observes the right to charge
the monthly payment as planned. All cancellations
must be made in the form of a support ticket
using http://my.KRYPT.com.
The service will be canceled immediately
upon receipt of the support ticket unless
specified by the customer to cancel at the
end of the billing period. If a web hosting
client changes registration information
without notifying Krypt, a $50.00 penalty
fee will be accessed. As of December 1st,
2004, there will be absolutely no refunds
given under any circumstance.
Krypt reserves the right
to modify these policy at any time, and
without warning.
